Welcome to JointGreetings, owned and operated by Invalid Memory, LLC ("we", "our", or "us"). By accessing or using our website at JointGreetings.com ("the Service"), you agree to these Terms of Service ("Terms") with Invalid Memory, LLC. If you do not agree to these Terms, please do not use the Service.
1. Description of Service
JointGreetings is a collaborative digital greeting card platform. Users can create greeting cards, invite others to add messages via a signing link, and send the completed card with a recipient using a link.
2. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.
3. User Accounts
Card creators may need to provide an email address. You are responsible for maintaining the confidentiality of your card management links. Card signers do not need an account and are identified only by the display name they provide.
4. Acceptable Use
You agree not to use the Service to:
- Post content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Send unsolicited or unauthorized advertising, spam, or promotional materials.
- Harass, bully, or intimidate any person, including using cards to send unwanted or threatening messages.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
We reserve the right to remove any content and terminate access to any user who violates these Terms, at our sole discretion and without prior notice.
5. User Content
You retain ownership of the content you submit to the Service (messages, names, etc.). By submitting content, you grant Invalid Memory, LLC a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the Service (i.e., displaying your message on the greeting card and delivering it to the recipient).
6. Card Creator Responsibilities
As a card creator, you are responsible for the content of your card, including all messages added by signers. You can review messages before sharing the card. Share the recipient link only where it will be welcome. Contact support if a message needs to be removed.
7. Pricing and Payment
During our beta period, the Service is free of charge. When we introduce paid plans, pricing will be clearly communicated before any charges are made. Cards created during the free beta period will not be retroactively charged.
8. Intellectual Property
The Service, including its design, code, graphics, and card templates, is owned by Invalid Memory, LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, Invalid Memory, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
11. Indemnification
You agree to indemnify and hold harmless Invalid Memory, LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.
12. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Invalid Memory, LLC operates, without regard to conflict of law provisions.
